What Does the Debt Collection Service Include?

The debt collection service includes reviewing the debt documents and identifying the basis of the claim, contacting the debtor or exploring a settlement, then choosing the appropriate court procedure where necessary, and following up enforcement when there is a judgment or an enforceable instrument. The route varies according to the type of debt, the capacity of the parties, the available documents, and whether the principal amount or its value is disputed.

When Do You Need a Debt Collection Lawyer in Oman?

The need for a legal review grows when payment is delayed, the debtor disputes the amount, or the claim requires court action instead of correspondence alone. Each file is examined according to its documents and the stage of the claim.

Unpaid invoices

Commercial invoices or amounts due that were not paid on the agreed date.

Supplier and contractor dues

Amounts arising from supplies, works or services performed but not paid for.

Debt proven by a document

A claim established by a contract, acknowledgement or written instrument that requires identifying the appropriate route.

Dishonoured cheque

A cheque whose value was not paid, requiring review of the original cheque, the bank document and the reason for non-payment; the Commercial Law sets special rules and deadlines for cheques.

Judgment or enforceable instrument

When there is a judgment or an enforceable instrument, the file moves from proving the right to enforcement against the debtor’s assets under the legally prescribed procedures.

Disputed debt

If there is disagreement over the underlying obligation, its value or its due date, the claim may require a lawsuit or another appropriate court route instead of a direct demand.

Debt Collection for Individuals and Companies

Debt collection files differ according to the relationship from which the debt arose, the capacity of the parties and the documents proving the claim. Individual and corporate debts are therefore each reviewed according to their circumstances, with the appropriate legal route identified.

Collecting individuals’ debts

A claim may arise from an amount established by a contract, acknowledgement, cheque or contractual obligation that was not fulfilled. The review starts by identifying the principal debt, its due date, the documents proving it, and whether previous payments or objections by the debtor affect how the claim is pursued.

  • Contracts and acknowledgements.
  • Cheques and financial claims.
  • Reviewing payments and objections.

Collecting companies’ debts

A claim may arise from supply, contracting or service agreements, invoices, purchase orders or other commercial transactions. The file is reviewed to identify the nature of the debt, the capacity of the parties and the available documents, then the competent judicial body and the appropriate procedure for the claim or enforcement according to the type of dispute.

  • Invoices and dues.
  • Supply, contracting and services.
  • Commercial disputes and enforcement.

For disputes where one party is a trader and which relate to its commercial business, the Investment and Commerce Court has had jurisdiction under its law in force since 1 October 2025, subject to the exceptions set by law.

Law Firm or Debt Collection Company?

The choice depends on the stage the debt file has reached. Some collection services may be limited to contacting the debtor and following up payment within their scope, while legal practice, representation before courts and giving legal advice are subject to the Advocacy and Legal Consultation Law in Oman.

The law provides that representing parties before courts and judicial bodies, as well as giving legal opinions and advice, are acts of legal practice that may not be carried out by anyone not registered on the rolls of practising lawyers, subject to the exceptions set by law.

The choice therefore does not depend on the name of the entity alone, but on what the file actually needs: payment follow-up, a legal review of documents, settlement, a payment order, a lawsuit, or enforcement of a judgment or enforceable instrument.

Demand and follow-up

  • Communicating about payment.
  • Following up the claim.
  • Negotiating a settlement depending on the case.
  • Following up the payment agreement.

Legal procedures and representation

  • Reviewing the legal position.
  • Preparing and taking court action.
  • Representation before judicial bodies.
  • Following up the judgment and enforcement procedures.

The stage the debt has reached and its documents determine the type of assistance required.

See the Advocacy and Legal Consultation Law issued by Royal Decree No. 41/2024 (Arabic) for the framework regulating the profession.

How Do We Handle a Debt Collection File?

1

Reviewing the principal debt and documents

The source of the debt, its value, due date, documents and any previous payments, settlements or objections are examined. This review determines whether the claim is clear and due or requires examining a wider dispute.

2

Demand and settlement where appropriate

The file may start with a documented demand or negotiation over payment if settlement serves the creditor’s interest. Settlement is not presented as a guarantee of speed or success, but as one of the routes assessed according to the debtor’s situation and the file’s documents.

3

Identifying the court route

If the claim needs to go to court, it is examined whether the conditions for a payment order are met or whether the dispute requires a lawsuit. The main procedural reference is the Civil and Commercial Procedure Law issued by Royal Decree 29/2002 (Arabic).

In commercial claims, where one party is a trader and the dispute relates to its commercial business, the jurisdiction of the Investment and Commerce Court under Royal Decree 35/2025 (Arabic), in force since 1 October 2025, is reviewed.

4

Enforcement when there is an enforceable instrument

Once there is a judgment or enforceable instrument, the claim moves to the appropriate enforcement procedures. The Supreme Judicial Council offers electronic enforcement services, including garnishment requests and other enforcement-related requests. Each step remains subject to its conditions and the decision of the competent judicial authority.

Documents That Help Start a Collection File

Not all of these documents need to exist in every file. At the start, it is enough to prepare what proves the source of the claim, its value and its due date; additional documents are identified after the review.

Collecting the Value of a Dishonoured Cheque

Cheques have special rules under the Commercial Law, so a claim for a cheque’s value is not automatically treated the same way as an invoice or any other contractual debt. When a cheque is dishonoured, the review starts with the original cheque, the bank statement or certificate, the reason for non-payment, and the cheque date and presentation date, then the appropriate legal route is identified based on the facts and documents.

The Commercial Law provides that a cheque is payable on sight and sets deadlines for presenting the cheque and bringing recourse actions, so the timing of action may affect the file.

For the provisions governing cheques, see the Commercial Law issued by Royal Decree No. 55/90 (Arabic).

A cheque file needs a separate review

Original cheque: to verify its details and content.

Bank statement: to establish the fact and reason of non-payment.

Reason for non-payment: as it affects the assessment of the available procedure.

Cheque and presentation dates: to check the deadlines related to payment and recourse.

Frequently Asked Questions About Debt Collection in Oman

The review can start with available copies to understand the type of claim and the strength of the documents, but some procedures may later require originals, certified copies or additional documents. It is therefore advisable to prepare the contract, invoice, cheque or acknowledgement, correspondence and available proof of payment before the appointment.

A payment order is considered when its legal conditions are met in the debt and documents; it is not used automatically in all claims. If there is a dispute requiring examination of the principal debt or its amount, the route may instead be a lawsuit. The option is determined after examining the documents under the Civil and Commercial Procedure Law.

Keep the original cheque and the bank document showing non-payment, and do not rely on a general description of the reason. The cheque’s details, date, reason for non-payment and the parties’ capacity are reviewed, then the appropriate route is determined under the Commercial Law, the applicable texts and the actual facts of the file.

Attachment or enforcement procedures may be available when there is a legal basis and an appropriate instrument and the conditions of the request are met. The type of procedure varies according to the assets to be enforced against, the stage of the file and the enforcement judge’s decision. Attachment is therefore not an automatic result of merely having a financial claim.

Claims arising from supply, contracting and service agreements, invoices and other transactions can be reviewed, identifying the nature of the relationship, the capacity of the parties and the supporting documents. In commercial disputes, the jurisdiction of the Investment and Commerce Court under the applicable law is also examined.

A cross-border claim requires examining where the obligation arose, where the debtor or their assets are located, the available instrument, and whether a judgment has already been issued. There is no single route for every country, so the step is determined after reviewing the country, the documents and the possibility of recognition or enforcement.
