Litigation and Judgment Enforcement Services in Oman

Litigation · Judgment Enforcement · Arbitral & Foreign Awards · Enforcement Disputes

Dr. Sarhan & Dr. Said Al-Risi Law Firm & Legal Consultancy provides litigation and judgment enforcement services in the Sultanate of Oman, including reviewing claims and documents, following up on proceedings before the competent courts, reviewing judgments and enforceable instruments, and filing enforcement requests according to the nature of each file.

A judgment holder may have a court instrument that requires enforcement action, or there may be a dispute that requires identifying the competent court and the appropriate procedure. Every file starts with a check of its procedural status and the available documents, without assuming that enforcement or recovery of the amount is possible merely because a judgment has been issued.

What Do Litigation and Enforcement Services Cover?

The legal work is defined by the type of dispute, the stage of the case and the scope of the engagement. The tracks that may apply to a file include:

Litigation and case follow-up

Reviewing facts, contracts and correspondence; preparing statements of claim and memoranda; and following up on hearings, applications and procedures before the competent court. Where agreed, the scope also covers studying the judgment and the available means of appeal according to their conditions and deadlines.

Enforcement of civil, commercial and labour judgments

Studying the judgment or enforceable instrument, verifying that it is enforceable, identifying the competent court, preparing the enforcement request and documents, and following up on the procedure.

Enforcement of arbitral awards and foreign judgments

These files require reviewing the award or judgment, the body that issued it, and the legal conditions for its recognition or for an enforcement order where required. Enforcement of every foreign judgment or arbitral award should not be assumed to follow the same procedure as a domestic judgment.

Enforcement disputes and objections

A dispute may arise over the validity or extent of an enforcement measure, or over a legal impediment to completing it. The appropriate step is decided after reviewing the instrument, previous decisions and the grounds of the objection, including the possibility of filing an application or grievance before the competent judicial authority.

The Omani government portal sets out the requirements for the civil enforcement request and labour enforcement request services, depending on the type of case.

When Is a Judgment Enforceable?

Before requesting enforcement, it must be verified that there is an enforceable instrument meeting the legal conditions, and that the judgment is capable of compulsory enforcement. Some judgments carry provisional enforcement, while others require different conditions to be met before enforcement can begin.

The Omani Civil and Commercial Procedures Law, issued by Royal Decree No. 29/2002, sets the general rules for enforceable instruments, enforcement procedures and enforcement disputes. A judgment in a party’s favour is not a guarantee that the amount will be recovered or that every attachment measure can be taken.

What Are the Steps to Enforce a Court Judgment?

Details vary with the type of instrument and the competent authority, but the general path usually includes the following stages:

1

Review the judgment or instrument

Reviewing the operative part of the judgment or instrument to confirm the right to be enforced, the parties and the obligation ordered.

2

Enforcement formula and competent authority

Verifying the enforcement formula or required enforceable document, and the authority competent to receive the request.

3

Prepare the enforcement request

Preparing the enforcement request with the documents and information needed to identify the judgment debtor and the subject of the request.

4

Follow up on notices and decisions

Following up on notifications, applications and decisions issued in the enforcement file according to the prescribed procedures.

5

Enforcement against assets

Examining enforcement measures against assets where their conditions are met and the necessary court decisions are issued.

6

Objections and disputes

Following up on objections and enforcement disputes until the procedures end or the appropriate decision is issued.

What Obstacles Can Arise During Enforcement?

Some files are delayed by missing information about the debtor’s assets, by a partial payment that is not clearly documented, or by an objection to an enforcement measure. The file is reviewed to identify the step that the facts and legal rules allow, rather than assuming one procedure fits every case.

Depending on the legal conditions, relevant procedures may include a request to attach the debtor’s assets held by third parties, which the government portal explains with reference to Article (387) of the Civil and Commercial Procedures Law. The government also offers a service for raising an objection to the enforcement of a civil judgment with reference to Article (363) of the same law.

Filing an objection or an attachment request does not automatically stay enforcement or result in attachment; the competent authority decides each request according to its circumstances and legal conditions.

What Documents Are Needed to Start Reviewing an Enforcement File?

Providing the core documents helps identify the stage the case has reached and the next step. Documents that may be required include:

Documents differ from case to case

The final documents depend on the nature of the case. There is no need to send the full case file or sensitive data via WhatsApp at the initial appointment-request stage.

Litigation Before the Investment and Commerce Court

Some commercial and investment disputes require jurisdiction to be determined under the Investment and Commerce Court Law, issued by Royal Decree No. 35/2025, rather than simply classifying the dispute as “commercial” in general terms. Identifying the path starts with reviewing the parties, the subject of the claim and the authority competent to hear it.

The Supreme Judicial Council also announced the preparation of a guidance manual on litigation procedures before the Investment and Commerce Court on 21 September 2026. It is useful when reviewing the requirements for filing a claim, application or appeal, but it does not replace the binding legal text.

Frequently Asked Questions About Judgment Enforcement in Oman

Start by reviewing the judgment to confirm it is enforceable, then prepare the required instrument or enforcement formula and identify the competent court. The enforcement request is then filed with the necessary information. The path changes depending on the type of judgment and whether there have been previous procedures, objections or amounts already paid.

Enforcement may be possible if the judgment carries provisional enforcement by law or by the court’s decision, while other judgments are subject to different rules. The issue date alone is therefore not enough; the wording of the judgment, the effect of any appeals and the rules governing its enforceability must be reviewed.

There is no single timeframe that applies to all enforcement files. The duration depends on the type of obligation, the notification procedures, the availability of information about the assets subject to enforcement, and any disputes or additional applications. No specific estimate should be relied on before the case file and the steps already taken have been reviewed.

If the instrument meets the conditions for enforcement, the appropriate applications can be filed for compulsory enforcement under the law. This may include measures relating to attachable assets where their conditions are met. A travel ban, attachment or other order is not issued automatically because of the refusal alone.

Filing an objection should not be treated as a final or automatic stay of all enforcement procedures. Its effect depends on the type of objection, the legal provision governing it and the decision of the competent court. The documents and the stage of enforcement must be reviewed before assessing whether a stay is possible.

Enforcement of these awards and judgments in Oman can be examined under the rules and conditions specific to each type, taking into account any international agreements that apply to the case. An enforcement order or additional documents may be required before compulsory enforcement begins, so the assessment starts with reviewing the award or judgment and its source.
