What Does the Accident Compensation Service Include?

A compensation claim differs according to the type of damage, liability for the accident, insurance cover and the available documents. Handling the file therefore starts by identifying the source of the claim and the type of damage before moving to negotiation or a lawsuit.

Road accident compensation

Covers reviewing claims arising from vehicle accidents and resulting injuries, death or material damage, examining the accident report and documents relating to liability and insurance. The Motor Vehicle Insurance Law grants a person harmed in a traffic accident a direct action against the insurer within the scope of the law and the insurance policy.

Compensation for accident injuries

When the accident causes bodily harm, the medical reports and documents proving the injury, treatment and its effects are reviewed, then the elements of damage are linked to the facts of the accident and liability. The Civil Transactions Law provides that compensation is assessed according to the damage and the loss of earnings suffered, provided it is a natural result of the harmful act.

Vehicle damage compensation

The claim covers damage to the vehicle according to liability, insurance cover and technical assessment. In 2026 the Financial Services Authority approved amendments to the unified motor insurance policy form, including regulating settlement periods for certain claims and providing options linked to cash compensation in specific cases.

Disputes with the insurance company

A dispute may arise over accepting the claim, the scope of cover, the assessment of damage or the amount of compensation. In this case, the policy, the claim file and the reason for the insurer’s decision are reviewed before deciding whether to continue negotiating, file a complaint or go to court.

How Do We Handle an Accident Compensation Claim?

A compensation claim does not start with an assumed amount, but by building a file that proves the accident, the damage and the link between them, then identifying the appropriate legal route.

1

Reviewing the accident and documents

Examining the accident report, the parties’ details, vehicle and insurance documents, medical reports and documents relating to the damage.

2

Determining liability and the claim route

Identifying the party or body to which the claim is directed and whether an insurance company is involved in the file.

3

Assessing the proven elements of damage

Reviewing injuries, material damage, expenses and the documents that support them.

4

Submitting the claim and dealing with the insurer

Following up the claim and reviewing any offer, rejection or request for further information.

5

Litigation and enforcement where needed

If the claim is not resolved by the appropriate route before court, jurisdiction is reviewed and lawsuit procedures are taken, followed by enforcement once an enforceable judgment is issued.

Documents That Help Review the Claim

The final documents depend on the type of accident and claim, but preparing the file usually starts with the following documents:

Additional documents may be requested depending on the type of claim

Royal Oman Police provides an accident and emergency reporting service through the police app as part of its services guide, and the Financial Services Authority requires specific data and documents when submitting an insurance complaint.

How Is Compensation Assessed After an Accident?

There is no fixed compensation amount that suits all accidents. The assessment depends on the nature of the proven damage, the extent of liability for the accident, the medical or technical documents, and the scope of insurance cover when an insurance company is party to the claim.

Under Article 181 of the Omani Civil Transactions Law, compensation is assessed according to the damage suffered by the injured party and the earnings lost, provided this is a natural result of the harmful act. The law also regulates more specifically compensation for harm to the person and for damage to property.

What factors affect the amount of compensation?

Nature of the damage

Bodily injury, treatment expenses, vehicle damage or other proven damage.

Evidence and documents

Medical reports, the accident report, invoices and damage assessment reports.

Liability for the accident

Identifying the liable party and how far the damage is linked to the act that caused the accident.

Insurance cover

The type of insurance policy, the limits of cover and the conditions that apply to the claim.

Vehicle a total loss? The Financial Services Authority provides an official service to calculate the compensation value of a vehicle after a total loss, which can be used as an official reference instead of relying on unapproved calculators. In 2026 the Authority also amended certain provisions of the unified motor insurance policy form.

What Should You Do If the Insurance Company Rejects the Claim?

An insurance company’s rejection of a compensation claim does not necessarily end the claim. The right step starts by reviewing the reason for rejection, the policy terms, the accident file and the documents already submitted, because the next action differs according to the reason for the decision and whether the file needs completing, an objection or escalation.

1

Review the reason for rejection

Request the reason for rejection clearly and compare it with the policy terms, the facts of the accident and the documents submitted. The rejection may relate to a missing document, a disagreement over cover, liability or the assessment of damage.

2

File a complaint with the insurance company

If the objection is to the company’s own decision, the complaint route starts by submitting it to the insurance company concerned, attaching the data and documents supporting the request.

3

Escalate the complaint to the Financial Services Authority

If the complaint is not resolved by the insurance company through the set route, you can move to the Financial Services Authority’s insurance complaints service and complete the requirements for escalation.

Claim Period and Limitation

Important note: no single figure applies to all compensation actions. The claim period differs according to the legal basis of the action, so the type of claim must be identified before relying on any period.

Compensation actions under the Motor Vehicle Insurance Law

Article (16) of the Motor Vehicle Insurance Law provides that actions arising from the application of this law shall not be heard after two years from the date of the incident giving rise to the action. The text also sets out two important cases:

  • If material information relating to the insured risk was concealed or incorrect material information was provided, the period runs from the date the interested party learned of the concealed or correct information.
  • Limitation is interrupted by a registered letter or by delivering the claim documents to the insurance company concerned within the prescribed period.

The amended text of the Motor Vehicle Insurance Law still sets out these provisions in Article (16), noting that the law has been amended up to Royal Decree 53/2021.

Compensation actions arising from a harmful act

Where the action is based on the harmful act provisions of the Civil Transactions Law, Article (185) provides that the action shall not be heard after five years from the day the injured party learned of the damage and of the person liable for it. The article adds two important rules:

  • If the compensation action arises from a crime and the criminal action is still pending after the five-year period, the compensation action is barred only when the criminal action is barred.
  • In all cases, a compensation action shall not be heard after 15 years from the day the harmful act occurred.

Which period applies to a road accident claim?

The period for claiming compensation for a road accident differs according to the legal basis of the action. The action may be subject to the two-year period in the Motor Vehicle Insurance Law, while harmful act actions are subject to Article (185) of the Civil Transactions Law. The facts of the claim and the capacity of the parties must be examined before determining the period that applies.

Determining the period does not depend on the type of accident alone, but on the legal basis of the claim.

Motor Insurance Updates in 2026

In January 2026 the Financial Services Authority approved amendments to the unified motor insurance policy form, and the amendments took effect after the regulatory grace period granted to insurance companies ended in February 2026. The amendments aim to regulate claim procedures and strengthen insurance protection for beneficiaries. Key changes include:

Frequently Asked Questions About Accident Compensation in Oman

The Motor Vehicle Insurance Law grants a person harmed in a road accident a direct action against the insurer. However, the insurance policy, the facts of the accident, liability and the documents must be reviewed before determining the route that applies to the case.

Ask for the reason for rejection and review the policy, the claim file and the documents. If the complaint is not resolved with the company, escalation to the Financial Services Authority can be assessed under the complaints service requirements, followed by determining whether a court route is needed.

No. The value varies according to the proven damage, liability, technical assessment, insurance cover and other elements of the file. No single amount or table can determine the value of all cases.

Bodily injuries and treatment expenses may fall within the scope of the claim depending on the injured party’s capacity, the insurance cover and the facts of the accident. The claim must be supported by medical reports, invoices and appropriate documents.

The accident report, vehicle and insurance details, medical reports, invoices and documents proving the damage are usually reviewed, and additional documents may be requested depending on the type of claim.

The period depends on the legal basis. The Motor Vehicle Insurance Law includes a specific period for actions arising from its application, while the Civil Transactions Law sets periods for compensation actions arising from a harmful act. The type of claim must therefore be identified before calculating the period.
